WAIVER
I have voluntarily elected to participate in one or more physical fitness activities offered by Mums Exercise Group Australia. These physical fitness activities include, but are not limited to, aqua aerobics, swimming, walking, running, bootcamps, weightlifting, pilates, team sports and other various fitness activities.
In consideration of Mums Exercise Group Australia allowing me to participate in its physical fitness activities, I accept the following terms and conditions:
1. I acknowledge that the level of physical activity required for each physical fitness activity offered by Mums Exercise Group Australia will depend on the nature of the physical fitness activity.
2. I acknowledge that some of the physical fitness activities offered by Mums Exercise Group Australia may involve strenuous physical activity.
3. I acknowledge that the risks and hazards associated with my participation in the physical fitness activities offered by Mums Exercise Group Australia include, but are not limited to, physical injury, death, and loss or damage to my property.
4. I warrant that I am in good physical condition and do not suffer from any disability, condition, impairment or limitation which would prevent or otherwise limit my full participation in the physical fitness activities offered by Mums Exercise Group Australia. In the event that there is a change to my physical condition, or if I subsequently suffer from any disability, condition, impairment or limitation, I will immediately limit or cease my participation (as appropriate) in the physical fitness activities offered by Mums Exercise Group Australia.
5. I warrant that I have attended my six week postpartum check-up, and that my General Practitioner or Obstetrician has medically cleared me to undertake the physical fitness activities offered by Mums Exercise Group Australia.
6. I acknowledge that I am solely responsible for any minors that the attend physical fitness activities offered by Mums Exercise Group Australia with me, and I will ensure that I appropriately supervise such minors at all times.
7. I release and indemnify Mums Exercise Group Australia and its volunteers from any and all liability, claim, action, proceedings, costs or expenses made or brought against Mums Exercise Group Australia and its volunteers for, or resulting from, any injury, loss or damage related to, arising from, or in any way connected with:
(i) my participation in the physical fitness activities offered by Mums Exercise Group Australia; and
(ii) minors that attend physical fitness activities offered by Mums Exercise Group Australia with me,
except where that injury, loss or damage results from any negligent or unlawful act or omission by the Mums Exercise Group Australia and its volunteers.
8. I authorise Mums Exercise Group Australia and its volunteers to seek emergency medical services for me, and any minors in my care, where required while I am participating in a physical fitness activity offered by Mums Exercise Group Australia. I acknowledge that I will be solely responsible for any expenses associated with these emergency medical services.
9. I will comply with, and adhere to, the directions and/or requirements of Mums Exercise Group Australia and its volunteers while participating in the physical fitness activities offered by Mums Exercise Group Australia. I will ensure that any minors that attend physical fitness activities offered by Mums Exercise Group Australia with me also comply with, and adhere to the directions and/or requirements of Mums Exercise Group Australia and its volunteers.
10. I will notify Mums Exercise Group Australia of any health and safety related incidents that have, or may have, occurred during my participation in the physical fitness activities offered by Mums Exercise Group Australia.
11. I acknowledge that Mums Exercise Group Australia and its volunteers are relying on the warranties, representations and undertakings that I have provided above, and that my participation in the physical fitness activities offered by Mums Exercise Group Australia is subject to these warranties, representations and undertakings.
